Hi!

Just got an empeg off ebay. The fact that no serial was posted, and that it was just an empeg * power supply with no mounting hardware made me slightly concerned, and my concerns are now aggravated by the fact that it arrived with the serial number sticker removed!

It could be a totally legitimate unit, but just wanted to check - anyone had their empeg stolen recently? It has a orange smoke lens, and seems to have intermittent hard disk (or IDE cable) problems.

Interesting - I don't think Kim's the seller, as the ebay description was:

THIS EMPRG HAS NO CAGE OR SOFTWARE JUST THE HOUSE ADAPTER TO POWER IT? IM NOT 100% SURE HOW IT WORKS I CAN GET IT TO POWER ON BUT I CANT TEST IT FOR SOUND I BOUGHT THIS FROM A MARKET SOME TIME BACK IN MIND TO GET A CAGE BUT NEVER GOT ROUND TO IT.SO IM NOW SELLING IT AS UNTESTED SOLD AS SEEN?

Interesting. Maybe a BBS admin could use his non-public e-mail address to try and ask him.

Or ONE of us could just ask him directly (one of us, not all of us).

Good detective work, maybe we can verify this.

If you paid by PayPal and think you need to claim a refund make sure you take note of the requirements and deadlines.

Actually, I wonder what the right thing to do is here - the seller might actually, as he claims, have picked the empeg up at a market, not nowing it was stolen. Will the fact that it *is* stolen be enough for ebay/PayPal to cancel the payment?

Yeah... Because you always get totally legitmate car stereos sold at markets with no serial numbers, accessories, sleds, manuals or anything else If that doesn't scream stolen then I don't know what would

I think what matters at this point is, does the original owner want it back? If so, make arrangements with them, and on their advice either apply for a refund or not.

If the original owner no longer cares at this point, then you might as well pay and keep it, as otherwise it'll either get scrapped or go to somebody else for similar money.

If it was bought at a market I doubt they paid very much for it, and as mentioned anybody buying car audio from a market will know that there is a good chance it has been stolen.

I could be wrong, but I think:

In the US, stolen goods are still stolen goods, no matter how many hands they've passed through, innocent or otherwise. If I buy a stolen empeg, even thinking it's a legitimate transaction, law enforcement officials have the right to reclaim it without reimbursing me. If that happens, I may be able to redirect the law enforcement to whomever I bought it from, but I'm not sure it would work to get my money back.

Until 1995 in the UK there was an ancient law of "market overt" where a sale made in at a public market is binding against all parties who have an interest in the title of the goods. ie. if you unknowingly bought something that turned out to be stolen you would still be the legal owner, unless subject to subsequent court order (which would probably only follow conviction of the proven thief).

This was repealed in the Sale of Goods (Amendment) Act 1994.

In any case, I'd presume that that doesn't mitigate the offense of Handling Stolen Goods?
